Legal Warranty of Conformity The legal warranty of conformity is governed by Articles 128 et seq. of the Consumer Code, in favor of the consumer who purchases products (consumer goods) for personal use (i.e., for purposes unrelated to their professional or business activities), which have conformity defects.
Conformity Defects Conformity defects refer to intrinsic and material flaws in an item, not easily removable, that significantly impact its usability, or appreciably reduce its value, or make it unfit for its intended use.
When the Legal Warranty of Conformity Does Not Apply The legal warranty of conformity does not cover product defects arising from normal wear and tear, abnormal or improper use, accidental events (e.g., falls), or defects maliciously caused to the product, nor does it cover defects arising from repairs made by parties other than the manufacturer or the seller.
How Ksport Applies the Legal Warranty of Conformity In the presence of a conformity defect, the customer has the right to the repair or replacement of the defective good (this is assessed by Ksport based on the nature of the defect) by Ksport, without any expense, unless the requested remedy is impossible or excessively burdensome compared to the other. If replacement or repair are not possible, the consumer still has the right to a price reduction or to have a sum refunded, commensurate with the value of the goods, upon returning the defective product to the seller.
Duration of the Legal Warranty of Conformity The legal warranty lasts two years from the delivery of the goods and must be claimed by the consumer within two months from the discovery of the defect: it is therefore necessary to always keep the proof of purchase (electronic receipt or the transport document included in the package).
How to Claim the Legal Warranty of Conformity To claim the legal warranty of conformity, it is necessary to send an email to [email protected] indicating the conformity defect, describing the problem in detail, and attaching photographic material as evidence of the defect. After analyzing the documentation sent, the Ksport customer service will give an initial indication to the customer whether the defect is due to a conformity defect or is attributable to one of the factors described in point 3. If a conformity defect is recognized, the customer will be authorized to send the defective product to Ksport to thoroughly verify whether the malfunction is due to a conformity defect. The product covered by the warranty must arrive at Ksport SRL within 30 days of the warranty approval. Shipping costs are borne by the customer. It is not possible to request a pickup service. If a conformity defect is confirmed, Ksport will repair or replace the goods within a reasonable time (which may vary from 10 to 30 days for domestically produced items, and from 30 to 60 days for internationally produced items) from the request and without any charge to the consumer. The costs of returning the repaired/replaced product to the customer are borne by Ksport. Product replacements may have limitations based on the manufacturer's supplies; in this case, Ksport will provide a refund of the sum or the supply of a product of equivalent value.
Transfer of Warranty The buyer may transfer the warranty right to third parties in the event of the transfer of the goods. In this case, it must always be the customer who placed the order to request the warranty.
